These Terms and Conditions ("Terms") govern access to and use of the SAR-OS software, web application, APIs, and associated documentation (together, the "Software"). By creating an account, authenticating, logging in, or otherwise using the Software, you ("the User", and where applicable your organisation) agree to these Terms. If you do not agree, do not use the Software.
The Software is intended for use by trained, qualified, and authorised search and rescue (SAR) personnel only. You may use the Software only where you are acting within a competent SAR authority or organisation, or are otherwise expressly permitted in writing.

The Software and all outputs are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, accuracy, reliability, or fitness for a particular purpose, to the fullest extent permitted by law. We do not warrant that the Software will be uninterrupted, error-free, or that any output will be accurate or complete.
Outputs depend on the quality, timeliness, and completeness of inputs and third-party data (including AIS vessel positions, meteorological and oceanographic data, charts, and terrain data), over which we have no control and for which we accept no responsibility. Such data may be delayed, incomplete, inaccurate, or unavailable. All outputs must be treated as estimates conditioned on those inputs.
Drift, datum, and probability outputs are the result of models and simulations incorporating assumptions and uncertainty. They represent likelihoods, not certainties, and may differ materially from actual conditions.
The Software may be unavailable due to maintenance, faults, or factors beyond our control. Your organisation must maintain business-continuity and fallback procedures independent of the Software. You are responsible for safeguarding credentials and for the use of multi-factor authentication and role-based access as provided.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. Subject to that, to the fullest extent permitted by law, we shall not be liable for any loss arising from any decision, act, or omission of any operator, Mission Coordinator, or SAR authority; any failure to detect, locate, or rescue any person or object; any inaccuracy in outputs or third-party data; or any indirect or consequential loss. This allocation of risk reflects the decision-support nature of the Software and is a condition of making it available.
You and your organisation shall indemnify us against claims, losses, and liabilities arising from use of the Software contrary to these Terms, reliance on outputs without the independent validation required by Section 4, or breach of applicable law.
You are granted a non-exclusive, non-transferable, revocable licence to use the Software for authorised SAR purposes only. You must not reverse-engineer, resell, or use the Software to provide a competing service, except to the extent such restriction is prohibited by law. Unauthorised use may be logged and reported to the appropriate authorities.
We may update the Software and these Terms from time to time. The "Last Updated" date above indicates when these Terms were last revised. Continued use after a change constitutes acceptance of the revised Terms.
These Terms are governed by the laws of Scotland, and the Scottish courts have exclusive jurisdiction, subject to any mandatory provisions of the User's jurisdiction. [Entity and jurisdiction to be confirmed by counsel prior to publication.]
